These Terms of Service (the "Terms") govern your access to and use of the R7 Van Rentals website and your rental of any vehicle from R7 Van Rentals ("R7," "we," "us," or "our"). By using this website or renting a vehicle from us, you agree to these Terms. Please read them carefully. The specific terms of any rental are also set out in the written rental agreement you sign before pickup; if there is a conflict, the signed rental agreement controls for that rental.
1. Reservations and appointments
Rentals are offered by appointment. To reserve a vehicle, contact us by phone or text at (678) 846-2317 and provide your requested dates. A reservation is not confirmed until we have agreed on the dates and vehicle and you have signed the rental agreement. We reserve the right to decline or cancel any reservation.
2. Driver eligibility and requirements
To rent, the primary renter and any additional drivers must hold a valid, unexpired driver's license, meet our minimum age and identification requirements, and satisfy the insurance requirements described in the rental agreement. You agree that all information you provide is accurate. Only drivers listed and approved on the rental agreement may operate the vehicle.
3. Rates, deposits, fees, and payment
Rental rates, any required security deposit, and applicable fees are disclosed to you before your rental begins. You authorize us to charge the payment method you provide for all amounts due under the rental agreement, including rental charges, deposits, and any post-rental charges such as fuel, cleaning, tolls, citations, or damage. A security deposit, if required, is refundable subject to the terms of the rental agreement.
4. Use of the vehicle
You agree to operate the vehicle safely, lawfully, and in accordance with the rental agreement and the manufacturer's guidelines. The vehicle must be used only for lawful personal or business transportation and must not be operated by anyone who is not an approved driver.
5. Prohibited uses
You may not use the vehicle: while under the influence of alcohol, drugs, or any impairing substance; to carry passengers or property for hire unless expressly permitted in writing; to tow or push anything; in any race, test, or contest; off paved roads; to transport hazardous or illegal materials; outside any geographic area stated in the rental agreement; or in any other manner prohibited by the rental agreement or by law. Smoking in the vehicle is not permitted.
6. Return, fuel, and condition
You agree to return the vehicle to the agreed location, on the agreed date and time, and in the same condition as at pickup, ordinary wear excepted. Unless otherwise agreed, the vehicle must be returned with the same fuel level as at pickup; otherwise a refueling charge may apply. Late returns may incur additional charges as described in the rental agreement.
7. Tolls, tickets, and citations
You are responsible for all tolls, parking violations, traffic citations, and related administrative fees incurred during your rental, together with any processing fee described in the rental agreement.
8. Damage, loss, and responsibility
You are responsible for loss of or damage to the vehicle during the rental period as described in the rental agreement, regardless of fault, up to the limits permitted by law. You must promptly report any accident, theft, vandalism, or mechanical problem to us and, where appropriate, to the police.
9. Insurance
You are required to maintain valid automobile insurance that covers your operation of the rented vehicle, as described in the rental agreement. You represent that such coverage is in force for the duration of the rental. We are not your insurer.
10. Cancellations, changes, and no-shows
You may request to change or cancel a reservation by contacting us as early as possible. Cancellation, change, and no-show terms, including any applicable charges, are described at the time of booking and in the rental agreement.
11. Assumption of risk and release
To the fullest extent permitted by law, you assume all risks associated with your use of the vehicle and release R7 from claims for loss or injury arising from your use, except to the extent caused by our gross negligence or willful misconduct.
12. Limitation of liability
To the fullest extent permitted by law, R7 and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or relating to your use of the website, the rental, or the vehicle. Our total liability for any claim will not exceed the amount you paid for the rental giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless R7 and its owners, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the vehicle, your breach of these Terms or the rental agreement, or your violation of any law or the rights of any third party.
14. Website use and intellectual property
The content on this website, including text, graphics, logos, and images, is owned by or licensed to R7 and is protected by applicable laws. You may not copy, reproduce, or use it without our permission. You agree not to misuse the website or interfere with its operation.
15. Third-party links and services
The website may link to third-party sites or services (for example, our payment processor or social media). We are not responsible for the content, policies, or practices of those third parties, and your use of them is at your own risk and subject to their terms.
16. Disclaimers
The website and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure, or that vehicle information is complete or current.
17. Governing law and venue
These Terms and any dispute arising out of or relating to them or to your rental are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute that is not subject to arbitration will be the state or federal courts located in Gwinnett County, Georgia, and you consent to their jurisdiction.
18. Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted on this website. Your continued use of the website or our services after changes are posted constitutes your acceptance of the updated Terms.
19. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the applicable rental agreement, constitute the entire agreement between you and R7 regarding their subject matter.
